3. Pricing, Estimates & Payments

The interactive estimate calculator provided on our platform offers an indicative, non-binding preliminary calculation designed to assist potential clients in assessing project scope, timeline, and budgetary considerations.

Calculations generated on the website do not constitute a formal or binding contractual quote. Final fees, itemized deliverables, and production schedules are formalized exclusively via a technical project specification and commercial service agreement or formal proforma invoice.

Supported payment methods include:

• Direct bank wire transfer (SEPA / international wire) to the official accounts designated on invoices.
• Encrypted electronic payment gateways (e.g., Stripe, major debit/credit cards).

Project billings are customarily structured in milestones: an initial deposit before work commences, intermediate milestone installments upon code deliveries, and final settlement upon sign-off.

4. Digital Delivery & Right of Withdrawal

Given the bespoke nature of our professional work — custom software development engineered to individual client specifications:

Pursuant to Article 16(c) and 16(m) of Romanian Government Emergency Ordinance (OUG) no. 34/2014 transposing Directive 2011/83/EU on Consumer Rights, contracts for the supply of digital content not delivered on a tangible medium and custom-made goods produced according to client specifications are exempt from statutory rights of withdrawal once execution has commenced with the client's prior express consent.

Deliverables are transmitted digitally (via encrypted archive transfers, secure Git repository provisioning, or direct server staging). Each delivery milestone includes an agreed acceptance review window during which our engineers rectify discrepancies against the written project specification.

5. Intellectual Property & Copyright

All intellectual property rights associated with the akqdevs.xyz website (including layout, graphic identities, trademarks, text, brand assets, and proprietary platform source code) remain the exclusive property of AKQ Developing.

For custom client projects: full copyright and economic exploitation rights in the custom application code developed specifically for the client are assigned and transferred upon receipt of full payment for the relevant project milestones, in accordance with the individual service agreement.

6. Limitation of Liability

AKQ Developing adheres to rigorous industry security standards and rigorous engineering practices. However, to the maximum extent permitted by applicable law, AKQ Developing shall not be held liable for:

• Service interruptions or infrastructure outages attributable to third-party telecommunications networks, hosting providers, or external cloud infrastructure.
• Modifications, tampering, or misconfigurations introduced to codebase deployments by client teams or unauthorized third parties following final acceptance.
• Indirect, consequential, or incidental losses, including lost revenue, lost profits, or business interruptions.

7. Governing Law & Dispute Resolution

These Terms and Conditions and any contractual relationships arising from the use of this website or our engineering services shall be governed by and construed in accordance with the laws of Romania and applicable European Union regulations.

Any disputes arising under or in connection with these terms shall first be submitted to good-faith amicable negotiation for a period of thirty (30) calendar days. Should amicable resolution fail, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Romania.
